Rules for Member Conduct and Behavior
Applies to, but is not limited to, all TAGteam materials, events, intellectual property, as well as the "1AppleFreeTech" and "TAGteam Leaders'" Lists
TAGteam Community was created in order to allow Macintosh Users Group (MUG) leaders, presenters, vendors and affiliates of TAGteam (collectively referred to as "Members") to communicate and network with each other and to build upon the strong common interests we all share as part of the Macintosh Users Group community. It is essential that everyone observe and honor the following Rules of Conduct and Behavior Agreement:
This agreement is intended to help enhance the Macintosh User Group (MUG) membership by preventing unacceptable use, conduct and behavior. Any request made by any named representative of a MUG for inclusion on our web site, members list, E-mail list, or other aspect of TAGteam constitutes an agreement by the named MUG represented to all of the terms and conditions set and put forth in this agreement. All members of The Apple Groups Team (TAGteam) and (the "Services") those who access some of our Services but are not formal member organizations ("Visitors"), as well as those individual group members who may or may not pay a fee to subscribe to the Services ("Members")-must comply with the information contained in this article.
We support the free flow of information and ideas however, we do actively monitor use of the Services under normal circumstances. We may remove any MUG, MUG's representative and/or materials from our organization and/or web site that, in our sole discretion, may be illegal, may subject us to liability, or which may violate this agreement. TAGteam may cooperate with Apple, Internet Service Providers, legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong. Your violation of this agreement, in part or in whole, may result in the suspension and/or termination of either your access to the Services and/or your TAGteam account or other actions as detailed in Section 3. This Agreement should be read in conjunction with our Internet Service Agreement and other policies.
2. VIOLATIONS OF TAGteam' ACCEPTABLE USE POLICY
The following constitute violations of this Agreement:
a. Illegal use. Using the Services to transmit any material (by email, uploading, posting, or otherwise) that, intentionally or unintentionally, violates any applicable local, state, national or international law, or any rules or regulations promulgated thereunder.
b. Harm to minors. Using the Services to harm, or attempt to harm, minors in any way.
c. Threats. Using the Services to transmit any material (by email, uploading, posting, or otherwise) that threatens or encourages bodily harm or destruction of property.
d. Harassment. Using the Services to transmit any material (by email, uploading, posting, or otherwise) that harasses another.
e. Fraudulent activity. Using the Services to make fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam such as "pyramid schemes," "Ponzi schemes," and "chain letters."
f. Forgery or impersonation. Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation. Using deliberately misleading headers ("munging" headers) in news postings in order to avoid spam email address collectors is allowed.
g. Unsolicited commercial email/Unsolicited bulk email. Using the Services to transmit any unsolicited commercial email or unsolicited bulk email. Activities that have the effect of facilitating unsolicited commercial email or unsolicited bulk email whether or not that email is commercial in nature, are prohibited.
h. Unauthorized access. Using the Services to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of TAGteam' or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data.
i. Copyright or trademark infringement. Using the Services to transmit any material (by email, uploading, posting, or otherwise) that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software. TAGteam is registered under the Digital Millennium Copyright Act of 1998.
j. Collection of personal data. Using the Services to collect, or attempt to collect, personal information about third parties without their knowledge or consent.
k. Reselling the services. Reselling the Services without TAGteam' authorization.
l.Network disruptions and unfriendly activity. Using the Services for any activity which adversely affects the ability of other people or systems to use TAGteam Services or the Internet. This includes "denial of service" (DoS) attacks against another network host or individual user. Interference with or disruption of other network users, network services or network equipment is prohibited. It is the Member's responsibility to ensure that their network is configured in a secure manner. A Member may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A Member may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner.
m. Vulgarity/Profanity and Offensive Language: Members are not allowed to use vulgar, profane, offensive or sexually explicit language on the site, in chat rooms, postings or communications. Members are not allowed to post offensive or sexually explicit pictures in their Profile pages. Use your best judgment. We all work together and represent each other in the MUG community no matter where we might be at any given time. If you have an opposing and/or different point of view; please choose your words carefully and refer only to the facts. Any type of "flaming," communicated abuse via electronic mail, written word, verbal, posted to any web site, listserv, newsgroup or other public outlet, or written abuse/attack, as determined by and at the discretion of the board of directors, is not acceptable nor permitted.
n.TAGteam considers "multiposting" to 10 or more groups within a two week sliding window to be excessive.
o. Members are not allowed to target another Member specifically to cause him or her distress, embarrassment or other discomfort, this is deemed simply one additional form of harassment.
p. Chain Letters: Transmission of chain letters, junk email, or bulk communications of any kind is not allowed.
q. No Soliciting: Members will not engage in advertising to, or solicitation of, other members to buy or sell any products or services that are either unrelated or that have not been approved for posting to the list (which is moderated anyway). This applies to non- MUG related activities but is at the discretion of the TAGteam leadership should any complaints and/or opposition be presented.
r. Using Member Information for Commercial Purpose or Financial Gain: No Member shall use any other Member's information, personal or otherwise, for any purpose or to obtain direct financial gain. Any such use must be reviewed by the board of directors or shall be deemed to be a violation of this Agreement. TAGteam, at its sole discretion, may terminate the Agreement and access to the TAGteam community with respect to any Member that uses such information for a commercial purpose or to obtain direct financial gain.
3. WEBSITE SECURITY RULES USERS ARE PROHIBITED FROM VIOLATING OR ATTEMPTING TO VIOLATE THE SECURITY OF THE WEBSITE, INCLUDING, WITHOUT LIMITATION:
a. Accessing data not intended for such user or logging into a server or account which the user is not authorized to access, b. attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization, c. attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the website, overloading, "flaming," "flooding", "spamming", "mailbombing" or "crashing", d. sending unsolicited email, including promotions and/or advertising of products or services, or e. forging any TCP/IP packet header or any part of the header information in any email or newsgroup posting.
Violations of system or network security may result in civil or criminal liability. TAGteam will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.
4.REPORTING VIOLATIONS OF TAGteam' Agreement
TAGteam requests that anyone who believes that there is a violation of this Agreement direct the information to Director-Abuse Department, at: " ."
If available, please provide the following information:
*The IP address used to commit the alleged violation *The date and time of the alleged violation, including the time zone or offset from GMT *Evidence of the alleged violation
Email with full header information provides all of the above, as do syslog files. Other situations will require different methods of providing the above information.
TAGteam may take any one or more of the following actions in response to complaints:
*issue warnings: written or verbal *suspend the Member's posting privileges *suspend the Member's account *terminate the Member's account *bill the Member for administrative costs and/or reactivation charges *bring legal action to enjoin violations and/or to collect damages, if any, caused by violations.
5. REVISIONS TO THIS ACCEPTABLE USE POLICY
TAGteam reserves the right to revise, amend, or modify this Agreement, our Internet Service Agreement and our other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification will be posted in accordance with the Internet Service
